Improvement of the situation of asylum seekers to UNHCR in Mongolia 

Community of the world sees your organization as one of the guarantees of human rights, and believes in you. 
We are grateful to the fact that, after the discovery in Ulaanbaatar office of the Regional Representative of the UN High Commissioner for Refugees (UNHCR), a lot of people who were exposed to violations of human rights and were in a dangerous and precarious position saved with the help of UNHCR, going to safe countries . 
In addition, we want to draw your attention to some serious adverse incidents that happened to UNHCR asylum in Mongolia. 

In October 3, 2009, police officers in Mongolia and China together have arrested a Chinese citizen Mongolian nationality Batzangaa (on official documents Batujangga) in Ulaanbaatar and forcibly sent to China. Do Batzangaa who escaped to Mongolia with his wife and daughter, was UNHCR asylum seeker certificate issued in May 29, 2009. 
While two employees of the UNHCR office in Mongolia cooperated with police representatives of the aforementioned countries, deceit lured Batzangaa in his office and illegally transferred them without a decision by the UNHCR. In China Batzangaa sentenced to four years' imprisonment, but for trying to escape, he was sentenced to 3 years in prison and is serving his sentence. 
In the midst of the hype associated with the issuance of Batzangaa, an employee of the UNHCR office N.Anar quit on their own, and office employee D.Erdenebulgan still works, one representing the UNHCR. 
In March 2012, closed the UNHCR office in Mongolia, allegedly due to financial problems, and began presenting D.Erdenebulgan UNHCR, combining another post.

Chinese citizen Mongolian nationality N.Alkhaa (on official documents Wenxin) lives in Mongolia since 1992, in 1994, married to a citizen of Mongolia, and in 1995 they had a daughter. In January 17, 2013 the police began to check it refers to unfounded reasons, allowing gross violations of human rights (he was amnested in November 11, 2013). N.Alkhaa approached UNHCR in January 26, 2013 received a Certificate of asylum seekers. But after a meeting in June 7, 2013 with an employee of the Regional UNHCR asylum-seeker status N.Alkhaa abolished, though he had all the prerequisites to become a refugee. 
In May 2014 the General Directorate for Citizenship and Migration (Mongolian Immigration) Mongolia formally notified N.Alkhaa no particular reason that he should go to China, or be deported. N.Alkhaa said to this protest, claiming self-immolation and began to carry a container with gasoline. N.Alkhaa approached UNHCR and June 4, 2014 again received the Certificate of asylum seekers. But there is notified that his case UNHCR closed, and it is unlikely he will be a refugee by this organization. 
In June 4, 2014 Mongolian Immigration gave him a residence permit for one year, with the head Mongolian Immigration said to the press that this document is not issued N.Alkhaa, and his parent-in-law Mongolian citizens.

Chinese citizens Mongolian nationality, UNHCR asylum-seekers D.Dalaibaatar, N. Tulguur and UNHCR refugee V. Tuvshinzaya informally detained in the May 12, 2014 in Mongolian Immigration, and the day unofficially deported D.Dalaibaatar, N. Tulguur in China. If in the May 12 due to luck is not given a visa V.Tuvshinzaya Czech Republic, it too would be deported. In May 14 employees Mongolian Immigration V.Tuvshinzaya a ride from an insulator for migrants directly to the airport before departure flight Ulaanbaatar-Moscow. 
Do D.Dalaibaatar (on official documents Dalaibateer) was an asylum seeker certificate (01/29/2014 - 04/29/2014), but the UNHCR representative in Ulaanbaatar D.Erdenebulgan not shown enough attention to extend his status, although a Chinese citizen repeatedly reminded him about their difficulties. D.Dalaibaatar still has a student visa valid until July 1, 2014. 
Do N.Tulguur (on official documents Tulaguer) was an asylum seeker certificate (03/18/2014-18/06/2014). In 2012 he married a citizen of Mongolia D.Batzaya. 
V.Tuvshinzaya (on official documents Dubuxinjiya), who came to Mongolia with his wife and two children, turned to UNHCR in July 2012 and received a Certificate of asylum seekers. Subsequently, he became a refugee by UNHCR in April 2014, it became clear that the Czech Republic is ready to accept him as a refugee. 
Mongolian Immigration gave notice N.Tulguur two times of unfounded deportation and D.Dalaibaatar and V.Tuvshinzaya not given notice. 
In April 2014 Mongolian Immigration employees and the General Intelligence Agency (GIA) of Mongolia started without specific reasons put forward the issue of the deportation of these three Chinese citizens. In April 18, 2014 Mongolian Immigration their detained, threatened with deportation and recalling that supposedly they will organize a conference on the theme of the separatist. Although they were assured that a conference on the historical theme organizes citizen of Mongolia and will not participate themselves, government officials said that even if it so be deported anyway. Only after the forced cancellation of the conference citizens of Mongolia, their temporarily released. 
For trying to deport unfounded and baseless detention of these persons, UNHCR and Amnesty International protested in writing.
Due to the recent structural reforms in UNHCR case of asylum seekers and refugees in Mongolia now belongs not to the Department of UNHCR in Beijing, and the department of UNHCR in Bangkok. In the May 7, 2014 Regional Coordinator of UNHCR in Bangkok James Lynch met with First Deputy Head Mongolian Immigration Ts.Tsolmon and other employees Mongolian Immigration and explained to them the reasons for the undeportation of those three young men. 
In May 9 N.Alkhaa supporters organized a press conference in his defense, and D.Dalaibaatar, N.Tulguur and V.Tuvshinzaya who came there just intrigued, employees of GIA power taken away and detained all day without clear reasons. Then GIA employees told them that "you have no violations, we will not deport you, you do not have to worry, in the morning on May 12 come with personal documents, will be a mere formality", etc. 
In May 12 the three young men were held in the morning in the GIA, in the afternoon Mongolian Immigration without telling anything about what awaits them. In the evening, employees of Mongolian Immigration, taken D.Dalaibaatar and N.Tulguur to the southern border and in May 13, handed them to the Chinese side. 
Since the beginning of pulling out the issue of deportation Mongolian Immigration employees and GIA committed serious human rights abuses against D.Dalaibaatar, N.Tulguur and V.Tuvshinzaya including torture deprivation, beatings, threats, insults and other Cruel, Inhuman or Degrading Treatment or Punishment, which are usually practiced in Mongolia and in relation to other Southern Mongols. 
Since little is known about those deported. Unofficial sources report their home and arrest the bad moral mental state. In July 15 D.Dalaibaatar requested in writing for assistance from human rights organizations and activists the world to help him restore his former life and activities.

Interested NGOs asked questions about writing and D.Dalaibaatar and N.Tulguur relevant government organizations in Mongolia, but they have not responded in writing and formally. Director of Mongolian Immigration said: "Decided on their deportations in GIA, we only got a ride to the border", the GIA employee: "Decided on their deportations in Mongolian Immigration already before", members of the National Human Rights Commission: "We do not have any information about their presence abroad, Minister of Justice stated that they would not deport them until the final decision of questions UNHCR", UNHCR Representative in Mongolia, said: "Nothing informing them deported more know nothing and we have nothing more to do".
About counted them lawbreakers government organizations in Mongolia are no facts. And therefore no grounds for deportation and deprivation of the right to enter Mongolia for 10 years.

Chinese citizen Mongolian nationality Kh.Arslan (on official documents Bao Ar Si Leung) fleeing from political persecution and harassment, crossed the border in Mongolia September 24, 2013. Kh.Arslan approached UNHCR and September 30, 2013 received a Certificate of asylum seekers. But after that he was not helped by UNHCR nothing. Even Mongolian Immigration still not granted him a residence permit. His situation is very alarming and risky. 

We care about the rights of southern Mongolia (Mongols in China), referring to the UN High Commissioner for Human Rights, asking: 
1. Take control of the situation D.Dalaibaatar and N.Tulguur, take them into care and protection, to collect and disseminate objective information about them, 
2. Encourage recovered UNHCR asylum seeker status in Mongolia D.Dalaibaatar and N.Tulguur, and the right of entry to Mongolia D.Dalaibaatar and N.Tulguur (in this case V.Tuvshinzaya too) continued their studies and work, as before, 
3. Take precautionary measures to reduce violations of human, political, civil rights, the rights of indigenous peoples and national minorities in Mongolia and China. 
4. Encourage asylum seekers and refugees by UNHCR in Mongolia to provide more effective protection from the UN. 
5. Improve and intensify the work of UNHCR in Mongolia, to open in Ulaanbaatar office of the Regional Representative of UNHCR, 
6. Revise the membership of Mongolia to the Human Rights Council of the United Nations in connection with the situation of human rights of Southern Mongols in Mongolia.
